RESPECTFUL, INCLUSIVE AND COMPLIANT WORKPLACES

PART 1: HARASSMENT, DISCRIMINATION, AND RETALIATION PREVENTION & BYSTANDER INTERVENTION

This Training is designed to prevent harassment, discrimination, and retaliation and promote bystander intervention, civility, and respect. It helps educate employees about unlawful and inappropriate conduct and reinforces the employer’s goals of affording safe and comfortable workplaces. It highlights the importance of being a good bystander through intervention and speaking up to stop inappropriate conduct and support colleagues. It is relevant for employees at all levels and non-employees who interact with employees.

The Training covers the legal framework pertaining to sexual harassment (hostile work environment/quid pro quo) as well as other protected categories of discrimination and retaliation, including, race, color, national origin, ethnicity, religion, sexual orientation, gender identity, age, disability, etc., and the broad legal remedies and individual liability. There is discussion on the current social and legal landscape, including a review of the protections afforded by the Create a Respectful and Open Workplace for Natural Hair Act (CROWN Act) and awareness of implicit/unconscious bias.

Additionally, the Training covers:

  • Factual scenarios demonstrating problematic conduct

  • Examples of verbal, non-verbal, and physically harassing conduct

  • Electronic communications, social media, and off-duty conduct

  • Understanding proper boundaries

  • Strategies in addressing unwelcome behavior

  • Reporting concerns under the employer’s policies

  • Complaints “protected” under the law

  • Strict prohibitions against retaliation

For those in leadership/managerial roles, the Training further includes instruction on practices to prevent and remediate prohibited conduct, such as:

  • Engaging in proactive efforts

  • Recognizing protected conduct

  • Responding to complaints

  • Escalating concerns once aware of potentially unlawful behavior

The Training highlights the importance of respect and civility in the workplace and the prevention of violence, abuse, intimidation, and bullying.

This Training can be tailored to suit the employer’s needs and is conducted live (on site or virtually). It is typically 2-3 hours but can be enhanced. KSB Law is also able to assist Employers with updating policies and practices on the areas covered in this Training.
