PART 2: ENSURING EQUAL PAY AND MINIMIZING DISPARITIES

This Training provides information to employers about addressing pay disparities proactively, implementing equal pay practices, and understanding the impact of legal changes in this area. It is targeted towards individuals serving in human resources, legal, compliance, or leadership roles.

With equal pay laws on the federal, state, and local levels, employers must be vigilant about ensuring that compensation disparities do not occur based upon gender and other protected categories under the law.

Equal pay lawsuits can result in significant exposure, especially given evolving laws that afford broader protections and expanded damages and penalties. Additionally, traditional equal pay affirmative defenses (such as prior salary history, salary negotiations, and market forces) are being challenged, particularly under expanded equal pay protections. Training is necessary to understand this emerging and complex area.

Training topics include:

  • Federal, state, and local equal pay laws

  • Existing pay practices

  • Disparities and areas of risk to minimize the likelihood of a lawsuit

  • Differences between “substantially equal” and “substantially similar”

  • Duties and comparable “skills, effort, responsibilities”

  • Permissible bases for pay differentials and adjustments

  • Importance and mechanics of self-evaluation audits

  • Legal trends in pay equity and including salary inquiry/transparency laws

  • Wage gaps and steering/channeling claims

Training components that are specific to NJ include:

  • Diane B. Allen Equal Pay Act

  • NJ’s Salary Inquiry Ban

  • Legal trends, including awarding treble damages and the 6-year lookback

This Training can be tailored to suit the employer’s needs and is conducted live (on site or virtually). It is typically 2-3 hours but can be enhanced. KSB Law also conducts Equal Pay Audits & Legal Assessments.
