EEO-1 Report Opens October 31, and Employers Must Submit by December 5, 2023

Covered employers should get ready to submit their EEO 1 Forms. The submission period opens on October 31, 2023 and ends on December 5, 2023. All submissions must be completed by December 5, 2023.

The EEO-1 Component 1 report is a mandatory annual data collection requiring all private sector employers with 100 or more employees, and federal contractors with 50 or more employees meeting certain criteria, to submit to the EEOC demographic workforce data, including data by job category, sex, and race or ethnicity.

To assist in the process of filing, the EEOC has issued an EEO 1 Instruction Booklet. In order to prepare, covered employers should begin to gather data from their workforces by having employees voluntarily self-identify. Further, employers should select and identify a workforce snapshot period for the 2022 EEO-1 Component 1 report of a pay period between October 1, 2022 and December 31, 2022. Data regarding employees as of that snapshot period needs to be included in the report.

Employers should be prepared to count employees by sex and race or ethnicity within ten specified job categories. Each employee must be counted in only one job category, sex, race, and ethnicity classifications. The Instruction Booklet contains guidance on various issues, including how to account for remote workers and employees who identify as non-binary.
