This session will review how employers and organizations can navigate challenging issues regarding employee privacy, political speech, and social media. In today’s increasingly digital workplace, it is critical to understand the rights of employees and balance that against the rights of employers to monitor employee activities for lawful and legitimate reasons.

  • Tort and common laws protections for workplace privacy
  • Curbing speech that constitutes harassment
  • Understanding when speech constitutes protected concerted activity under the National Labor Relations Act
  • Best practices for employers concerning social media
  • Monitoring employee communications and activities legally and ethically
  • Creating effective workplace policies regarding employee privacy and speech
