The Firm’s attorneys are experienced and seasoned employment lawyers and trainers who create interactive and meaningful learning experiences. They bring a wealth of knowledge to their training, having decades of collective experience in employment law counseling, negotiations, litigation, training, and investigation services.  Our attorneys are also educators involved in teaching and other programs at both the university and law school level. They draw from this experience to provide clear and easy to understand education on legal obligations while also engaging attendees on real life examples from cases and hypothetical scenarios that help the audience evaluate situations in real time during the training.

The Firm offers services in this area to law firms, private and public companies, educational institutions, non-profit organizations, and local, county, and state governmental entities and agencies. KSB Law also conducts workshops for businesses and organizations of all types and sizes in the private and public sectors, as well as coaching and training for individuals.

Training Programs are offered for employees at all levels, including upper management, executive, human resources, legal, leadership, managers, supervisory and non-supervisory staff as well as independent contractors and third parties involved with the organization.

The Training Programs are offered in a variety of venues and formats, including virtually (on Zoom and other platforms), large auditoriums, small roundtables, and one-on-one sessions.

ONE-ON-ONE COACHING & EDUCATION

KSB Law delivers One-on-One Coaching & Education with a customized approach. Such sessions are helpful when an employer’s valued executive, supervisor, manager, or non-supervisory employee would benefit from training on issues related to leadership, performance improvement, or a deeper understanding of sensitivity issues related to harassment, discrimination, retaliation, unconscious bias, cultural awareness, diversity, equity, inclusion, treatment of employees receiving reasonable accommodations, workplace communication, bullying, civility, and leadership/managerial styles. One-on-One Coaching & Education may consist of a single session or a series of interactive sessions.

Following is a list of the current training topics and programs offered by KSB Law:

RESPECTFUL, SAFE, INCLUSIVE, AND BIAS-FREE ENVIRONMENTS

Harassment, Discrimination, and Retaliation Prevention & Civility/Bystander Intervention

This Training covers the legal duty that employers have to prohibit harassment, discrimination, and retaliation in the workplace based upon a variety of legally protected categories under federal, state, and local laws. The Trainers discuss how improper conduct may violate an employer’s policies and procedures. Additionally, the Training is designed to promote bystander intervention, civility, and respect in the workplace. This Training also identifies bullying, violent, and abusive behaviors at work.

Unconscious/Implicit Bias & Cultural Awareness

This Training is designed to help participants to identify their own implicit/unconscious biases and work toward overcoming them and becoming more culturally aware. It reviews specific behavioral steps to interrupt biases and challenge stereotypes and prejudices in professional interactions. This Training also covers awareness of microaggressions and microinequities and how they can demean and stereotype individuals of historically marginalized groups. Employees at all levels need to appreciate how their backgrounds influence their interactions with each other within the workplace and how their own cultural experiences shape who they are and how they see the world.

Diversity, Equity, and Inclusion

This Training discusses how to create a diverse and inclusive workplace and create fair and equitable opportunities for all employees. It will discuss how to establish fair criteria for recruiting, hiring, promoting, and determining pay and other compensation. It can also address the procedures for seeking reasonable accommodations, and the need for workplace flexibility and creating employee resource groups and open-door policies.

Appreciating Generational Differences at Work

This Training educates on tackling age-based assumptions and stereotyping and the importance of valuing the contributions and lessons that each generation provides. It stresses varying communication styles and behaviors for different generations and the importance of assembling age diverse teams who can learn from each other. This Training also encourages mentoring relationships and open communication with a shared goal of appreciating the differences among the generations.

Mindfulness, Balance & Well Being

These sessions provide work-life balance and overall wellness training with an emphasis on competency, productivity, and ethical decision-making as key components to healthy work environments. With more individuals seeking work-life balance, flexible work arrangements, and remote work options, organizations need to address and assess their responses to these areas. This training provides strategies on how to address these concerns and how to prioritize physical, emotional, and occupational well-being.

AVOIDING EMPLOYMENT COMPLIANCE PITFALLS FOR MANAGERS

Employment Law 101: Understanding the Basics – Interviewing Through Termination

Training topics include a basic overview on an array topics, such as: understanding key federal, state, and local employment laws; recruiting, interviewing, and hiring, applications and background checks; salary inquiry bans; equal pay compliance; harassment/discrimination/retaliation concerns; medical, family, and sick leaves; reasonable accommodations, medical exams, tests, inquiries (including COVID-19, disabilities, religious, and service or assistance animals); drug use and testing, cannabis (marijuana); whistleblower concerns; safety, health, and worker injuries; overtime and misclassification issues; importance of job descriptions and accurate evaluations; privacy concerns; NLRB protections; managing a unionized workforce; and social media and off duty conduct.

Effective Performance Management & Communication

Training topics include: conducting bias-free performance evaluations; providing warnings and disciplinary action; proper documentation practices; performance improvement plans; coaching and counseling employees; providing constructive feedback; effective/productive communication; avoiding bias in employment documentation and evaluations; handling difficult situations and tough conversations; effective conflict resolution and working collaboratively; and management styles and model leadership behaviors.

Navigating Leaves, Disabilities & Accommodations

This Training will allow managers to understand the nuances in handling complex issues related to employee leaves, disabilities, and accommodations. It is essential that these areas are carefully managed given how federal, state, and local laws apply and intersect. This Training also reviews the importance of not overreaching and inquiring into medical/health information and the confidentiality requirements related to these areas, as well as ensuring that retaliation does not occur in response to requests or grants of leave or accommodations.

HUMAN RESOURCES, COMPLIANCE & LEADERS

NJ Cannabis Law

This Training tackles the latest development in Cannabis Law in NJ, minimizing exposure regarding employee discipline related to cannabis use. The training addresses the legal requirements for the Jake Honig Compassionate Use Medical Cannabis Act and the Cannabis Regulatory Enforcement Assistance, and Marketplace Modernization Act; the need for appropriate workplace training and policies and the process for evaluating potential impairment during prescribed work hours; current legal requirements, guidance, and trends regarding cannabis use in the employment setting; and how to recognize and avoid potential areas of discrimination and retaliation.

Conducting Effective Workplace Investigations

This Training covers key steps in conducting effective investigations. It addresses understanding microaggressions and unconscious/implicit bias and the importance of utilizing well-trained, impartial, and culturally competent investigators. This Training covers making credibility assessment and findings that will withstand scrutiny and addressing the attorney-client and attorney work product privileges and confidentiality instructions that comport with current law. It also addresses legal updates and guidance that impacts investigations.

Conducting a Workplace Culture/Climate Assessment

This Training highlights the importance of conducting a workplace culture and climate assessment and recognizing areas in an organization that may be in need of legal exploration. The Trainers discuss how to ascertain culture/climate perceptions and pinpoint the organization’s strengths and weaknesses that require action through training, investigation, or other remedial measures.

Employment Law Compliance

This Training assists employers and managers in navigating a variety of issues that arise throughout the employment relationship, from recruiting and hiring to discipline and termination. Equal Pay Compliance & Audits

This Training discusses key tools and strategies to comply with equal pay laws and salary history bans. It addresses updates in the law impacting equal pay claims, analysis, and defenses. This Training reviews steps in conducting important self-evaluation tools for employers to identify and remediate compensation disparities and to modify existing policies and practices that result in pay disparities to help limit potential exposure and damages and ensure pay equity among employees.

Service and Assistance Animal Awareness

This Training addresses reasonable accommodation requests related to service and assistance animals. It covers unique requirements related to service and assistance animals. The Trainers discuss appropriate treatment by supervisors and coworkers who might encounter service or assistance animals at work. Special Training Programs are also available that are geared towards the retail and housing industries and cover specific access requirements that must be followed by retail workers and personnel involved in the sale, leasing, and management of housing. It also discusses prohibited conduct towards individuals with service or assistance animals.


LAW FIRM & LEGAL PROFESSION

KSB Law assists law firms and legal departments with training and efforts related to implicit bias, cultural competency, harassment, discrimination, and harassment prevention, as well as building diversity, equity and inclusion strategies, women’s leadership initiatives and tackling challenges surrounding advancement and retention of women and underrepresented attorneys. The Firm also assists with bias prevention and remediation through climate assessments, investigations, and equal pay audits.


ACADEMIC INSTITUTIONS & SCHOOLS

KSB Law focuses on issues that that arise in school settings and involve faculty, staff, and student interactions, including facilitating meaningful programs on unconscious bias, cultural awareness, unpacking privilege, and combatting youth bias and ensuring that students are treated fairly and equally.
