Evolving Challenges: High Stakes Workplace Investigations

June 18 @ 12:00 pm - 1:00 pm

Free

High-stakes workplace investigations demand a strategic, disciplined, and carefully structured approach. Allegations involving senior leadership, systemic misconduct, retaliation, or potential regulatory exposure can present heightened legal, reputational, and organizational risk. In these situations, investigators must navigate complex factual records, sensitive workplace dynamics, and increased scrutiny from stakeholders both inside and outside the organization.

Join us on June 18, 2026, for a KSB Law Lunch and Learn, where we will explore the core principles and practical strategies for managing complex and high-stakes workplace investigations. This session will provide guidance on how to plan, conduct, and conclude investigations that may carry significant legal and organizational consequences, while maintaining fairness, credibility, and investigative integrity.

Topics to be addressed include:

  • Identifying when an investigation becomes “high stakes,” assessing legal and reputational risk, and defining the appropriate investigative scope
  • Ensuring investigator independence and determining when to engage outside counsel or external investigators
  • Planning and conducting complex investigations, including evidence management, documentation practices, and investigative strategy
  • Interviewing witnesses in sensitive or high-risk matters, including senior leadership and reluctant participants, while applying trauma-informed techniques where appropriate
  • Making and documenting credibility determinations and investigative findings in a defensible manner
  • Managing outcomes and organizational risk, including interim measures, corrective action, retaliation prevention, and post-investigation follow-up

Please note that this program is FREE and offers 1 PDC SHRM credit and 1.2 NJ CLE credits (pending approval).
