Artificial intelligence (AI) is fundamentally changing the workplace and may be a useful tool for employers when it comes to various workplace tasks, whether it be hiring or evaluating employees or monitoring their performance. However, employers must recognize that there are significant risks that come with the use of AI and it may perpetuate biases based on protected class thus leading to an enhanced risk of liability under EEO and discrimination laws as well as laws with respect to privacy and security. Judge Hedges, Principal of Ronald J. Hedges LLC and former a United States Magistrate Judge in the District of New Jersey, speaks and writes on a variety of topics, many of which are related to electronic information, including procedural and substantive criminal law, information governance, litigation management, and integration of new technologies such as artificial intelligence into existing information governance policies and procedures. He is also the chair of the Court Technology Committee of the Judicial Division of the ABA and a member of the artificial intelligence committees of the New Jersey and New York State bar associations. Stephanie Wilson is a recently retired partner at Reed Smith LLP where she worked in Reed Smith’s Financial Services Group for over 28 years. Her practice entailed advising and representing financial services clients in regulatory and civil actions that involved, among other things, use of artificial intelligence and generative AI products, employment, and discrimination issues. Since retiring she continues to advise on artificial intelligence, generative AI, employment, and discrimination issues.
